1. Introduction

Welcome to Spanish Driving Theory. These Terms of Service ("Terms") govern your use of our web application located at spanishdrivingtheory.com (the "Service"), operated by Zubair Idrees (operating as an Autónomo), registered in Spain at Carrer de la Indipendencia 74-76, 4-2, Badalona, Barcelona, Spain with NIF/NIE Z4606605D ("we," "us," or "our").

2. Description of the Service

The Service provides a study aid for the Spanish DGT driving-theory exam, including practice tests, a theory book, road-signs reference, and audiobooks. You must create an account to use the Service.

• Free Tier: Includes a one-time trial practice test of 30 questions.
• Paid Tier (Premium): Full access to all content. Pricing is EUR 15 per month or EUR 40 per 3 months.

3. Subscriptions, Payments, and Cancellation

• Auto-Renewal: Paid subscriptions are auto-renewing. Your payment method will be charged automatically at the end of each billing cycle (monthly or every 3 months, depending on your plan) unless you cancel.
• Cancellation: You may cancel your subscription at any time via your account settings (Customer Portal). If you cancel, your access to the premium content will continue until the end of your current paid billing period. We do not offer prorated refunds for partial periods.
• Failed Payments: If a renewal payment fails, your premium access will be suspended, and your account will revert to the free tier until payment is successfully processed.
• Taxes: Prices are currently shown and charged as a flat amount (EUR 15/month or EUR 40/3 months); VAT is not separately calculated or itemized at checkout.
  To-do before accepting payment from EU consumers at scale: confirm VAT-registration/OSS obligations as an autónomo selling digital services to EU consumers, and consider enabling Stripe Tax (or an equivalent) so VAT is calculated and collected correctly per customer location. This line must be updated to reflect the real tax treatment once resolved.

4. Intellectual Property and Acceptable Use

All content within the Service, including theory texts, questions, images, and audio, is owned by us or our licensors. When you subscribe or create an account, we grant you a personal, non-exclusive, non-transferable license to use the Service solely for your personal studying.

You may not:

• Scrape, copy, or automatically extract content from the Service.
• Resell, redistribute, or publicly display our content.
• Share your account credentials with others. Accounts are strictly for individual use.

5. Disclaimer of Warranties

The Service is provided as a study aid only. Passing our practice tests or completing our material does not guarantee that you will pass the official DGT driving exam. The Service is provided "as is" without any warranties, express or implied.

6. Limitation of Liability

To the maximum extent permitted by applicable law, our liability to you for any damages arising from your use of the Service shall not exceed the amount you paid us in the 12 months preceding the claim. We are not liable for any indirect, incidental, or consequential damages.

7. Termination

We reserve the right to suspend or terminate your account at any time if you violate these Terms (e.g., scraping content or sharing accounts). You may terminate these Terms by deleting your account and cancelling your subscription.

8. Governing Law and Dispute Resolution

These Terms are governed by the laws of Spain. However, if you are a consumer residing in the European Union, nothing in these Terms deprives you of the protection afforded to you by the mandatory consumer protection laws of your country of residence. EU consumer law overrides any conflicting clause in these Terms.

9. Changes to These Terms

We may update these Terms from time to time. We will notify you of any material changes by sending an email to the address associated with your account or by displaying a prominent notice within the Service.
